Terms of Service

Article 1 (Purpose)
These Terms of Service (these "Terms") set forth the conditions for use of the AI-powered travel planning web application "Plavia" (the "Service") provided by the Plavia operator (the "Operator"). Users shall use the Service after agreeing to these Terms.
Article 2 (Definitions)
The terms used in these Terms are defined as follows:
- "User" means an individual or legal entity that uses the Service provided by the Operator after agreeing to these Terms.
- "Travel Plan" means a travel itinerary generated by AI based on information entered by the User.
- "User Input Information" means information entered by the User through the Service, including destination(s), travel period, interests, travel style, departure point, budget, number of participants, accommodation preferences, etc.
- "Generated and Stored Data" means data generated and stored through the Service, including travel plans, schedules, accommodation information, weather information, sharing tokens, etc.
- "Local Storage" means temporary data stored in the User's browser.
- "Server Side" means servers and databases managed by the Operator.
- "Third-Party Services" means external services used by the Operator in providing the Service.
Article 3 (Use of the Service)
- Users shall use the Service in accordance with these Terms and the Privacy Policy separately established by the Operator.
- The Service utilizes AI (Google Gemini) and integrates weather forecasts and map information to create and share itineraries according to Users' preferences.
- The main features of the Service are as follows:
- AI-powered automatic itinerary generation, weather forecast integration, map display
- Plan saving and sharing (URL sharing), PDF export
- Multi-destination support (itineraries covering up to 5 cities)
- Users shall not provide false information when using the Service.
Article 4 (Handling of User Input Information and Generated/Stored Data)
- The Operator shall acquire and use User Input Information and data generated and stored through the Service (collectively, "User Data") for the purpose of providing the Service and improving its quality.
- User Data is stored in the following locations:
- Server Side: Travel plan and schedule data is stored in Supabase (PostgreSQL). The data center uses AWS (United States or designated region) and is accessed only through the Go backend.
- User Side: A cache of the plan list is stored in the browser's local storage. This is stored on the User's device and is not transmitted externally.
- By using the Service, Users expressly consent to the transmission of portions of User Data to the following third-party services. All such transmissions are made through the backend, and User Data is never transmitted directly from the frontend to third-party services.
- Google Gemini API (United States, Google): User Input Information including destination(s), dates, budget, interests, number of participants, etc. is transmitted for AI itinerary generation.
- OpenWeatherMap API (United Kingdom, OpenWeather Ltd.): Destination coordinates and dates are transmitted for weather forecast retrieval.
- Google Geocoding API (United States, Google): Place names are transmitted for coordinate conversion (geocoding).
- Google Custom Search API (United States, Google): Information necessary as search queries, such as tourist attraction names and locations, is transmitted for tourist spot information retrieval.
- The Operator shall take maximum care to protect Users' personal information and comply with applicable privacy laws and regulations.
Article 5 (Data Retention Period and Deletion)
- Currently, User Data stored in the server-side database is retained until a deletion request is made by the User.
- Data stored in the User-side local storage is retained until the browser cache is cleared.
- Users may request the Operator to delete User Data, and the Operator shall respond to such requests within a reasonable period. Deletion requests should be sent to the contact address listed at the beginning of these Terms.
- The Operator plans to implement a feature in the future that will allow Users to delete data directly.
Article 6 (Security)
- The Operator provides the Service with the following structure to ensure the security of User Data and external API keys:
- External API keys are held only in the backend and are not exposed to the frontend.
- Direct access from the frontend to third-party services (external APIs) is prohibited.
- Database access is restricted to the backend only.
- Users shall ensure the security of their devices at their own responsibility.
Article 7 (Prohibited Conduct)
Users shall not engage in any of the following conduct when using the Service:
- Conduct that violates laws or public order and morals
- Conduct related to criminal activities
- Conduct that infringes intellectual property rights, portrait rights, privacy, honor, or other rights or interests of the Operator, other Users, or third parties
- Conduct that uses the Service for improper purposes
- Conduct that may interfere with the operation of the Service
- Other conduct that the Operator deems inappropriate
Article 8 (Changes, Suspension, or Termination of the Service)
- The Operator may change, suspend, or terminate all or part of the Service without prior notice to Users.
- The Operator shall not be liable for any damages incurred by Users due to changes, suspension, or termination of the Service.
Article 9 (Links to External Services)
- The Service provides links to external travel-related services (hotel reservations, activity bookings, transportation reservations, eSIM/travel insurance, etc.) to improve user convenience.
- These links are provided as reference information, and the Operator does not guarantee the content, quality, safety, accuracy, etc. of such external services.
- When Users use external services, the terms of service and privacy policy of each service apply. The Operator shall not be responsible for any troubles, damages, disadvantages, etc. arising between external services and Users.
- Some of the links provided by the Service are affiliate links, and the Operator may receive referral compensation if Users make reservations or purchases through these links. However, this does not increase the amount Users pay.
- The Operator strives to provide information beneficial to Users without favoring specific services.
Article 10 (Display of Advertisements)
- The Service may display advertisements to support service operation.
- Advertisement content is delivered by third parties (such as Google AdSense), and the Operator does not directly manage or guarantee the advertisement content.
- Temporary cookies may be stored on Users' devices due to advertisement display. Please refer to the Service's Privacy Policy for details.
- The Operator shall not be liable for any damages incurred by Users due to advertisement display, except in cases of intentional or gross negligence by the Operator.
Article 11 (Disclaimer)
- The Operator makes no warranty that the Service is free from defects in fact or law (including defects related to safety, reliability, accuracy, completeness, effectiveness, fitness for a particular purpose, security, errors or bugs, infringement of rights, etc.).
- The Operator shall not be liable for any damages incurred by Users arising from the Service, except in cases of intentional or gross negligence by the Operator. However, if the Service constitutes a consumer contract as defined in the Consumer Contract Act, this disclaimer shall not apply, but even in such cases, the Operator shall not be liable for damages arising from special circumstances (including cases where the Operator or User foresaw or could have foreseen the occurrence of damages) among damages incurred by Users due to breach of contract or tort caused by the Operator's negligence (excluding gross negligence).
- The Operator shall not be responsible for any conduct performed by Users using the Service and the results thereof.
- The Operator makes no warranty regarding the accuracy, usefulness, etc. of information obtained by Users through the Service.
Article 12 (Changes to Terms)
The Operator may change these Terms when deemed necessary. The revised Terms of Service shall take effect from the time they are displayed on the Service. The Operator will endeavor to notify Users of significant changes through display on the Service or by reasonable means.
Article 13 (Governing Law and Jurisdiction)
- These Terms shall be governed by and construed in accordance with the laws of Japan.
- In the event of any dispute arising in connection with the Service, the district court having jurisdiction over the Operator's location shall have exclusive jurisdiction as the court of first instance.
